Terms of Service

1. Acceptance of Terms

By accessing or using ClaimDuty, operated by ClaimDuty LLC (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ClaimDuty helps veterans navigate the VA disability claims process using AI. This includes condition research, personal statement generation, buddy letter generation, VA Records analysis, decision letter analysis, evidence tracking, and C&P exam preparation resources.

3. Important Disclaimer

For legal advice regarding your VA claim, consult an accredited Veterans Service Organization (VSO), VA-accredited attorney, or claims agent.

4. Accounts

• •You must provide accurate information when creating an account.
• •You are responsible for maintaining the security of your account credentials.
• •You must be at least 18 years old to use the Service.
• •One account per person. Do not share account access.

5. Subscriptions and Payments

• •Free accounts have limited access to AI features as described on our pricing page.
• •Paid subscriptions are billed monthly through Stripe.
• •You may cancel your subscription at any time. Access continues through the end of the current billing period.
• •Refunds are handled on a case-by-case basis. Contact info@claimduty.com.

6. Your Data

Your data belongs to you. Here is what you need to know:

• •We do not sell your data. Not in any form, including de-identified or anonymized data.
• •You can export your data at any time, including all generated documents.
• •You can delete your account by emailing info@claimduty.com. We permanently delete 100% of your data within 45 days of your request.
• •Dormant accounts: If your account is inactive for 24 months, we will email you before taking any action. You will have 30 days to reactivate.

7. Acceptable Use

You agree not to:

• •Use the Service for fraudulent purposes or to submit false claims to the VA.
• •Attempt to reverse-engineer, scrape, or extract data from the Service.
• •Present generated content as professional legal or medical advice.
• •Resell or redistribute content generated by the Service.
• •Use the Service on behalf of another person without their explicit consent.

8. Intellectual Property

Documents generated through ClaimDuty are yours to use for your VA claims. The Service itself, including its design, code, and AI prompts, remains the intellectual property of ClaimDuty LLC.

9. Limitation of Liability

ClaimDuty is provided “as is” without warranties of any kind. We are not liable for any claim outcomes, rating decisions, or damages arising from use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time by emailing info@claimduty.com. Upon deletion, all your data will be permanently removed within 45 days.

11. Changes to Terms

We may update these terms from time to time. When we make significant changes, we will notify you by email at least 30 days before the changes take effect. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after changes take effect means you accept the updated terms.

12. Governing Law

These terms are governed by the laws of the State of Illinois. Any disputes will be resolved in the courts of Madison County, Illinois.
